These terms govern use of the QubikOS platform and website operated by QubikOS LLC, 3810 Prospect Ave, Ste B, Yorba Linda, CA 92886, United States. If a studio has signed an agreement with QubikOS, such as the QubikOS Terms of Service, that agreement alone governs the studio’s use of the service and prevails over these terms.
QubikOS provides software that gyms, gymnastics studios and similar activity programs use to manage enrollment, class schedules, attendance, skill progress, billing and communication with member families. Studios subscribe to the service and are responsible for the data they enter and the messages they send to their own members.
You are responsible for keeping your login credentials confidential and for activity that occurs under your account. Notify us promptly of any unauthorized use. We may suspend an account that is used unlawfully, that abuses the service, or that violates these terms.
Subscription fees and payment processing rates are as stated at the time of purchase. Payments from a studio’s members are processed through the studio’s own merchant account, with a payment processor or the studio’s own Stripe account, under the studio’s agreement with that provider. Studios are responsible for the accuracy of charges they issue to their own members. Fees are non-refundable except where required by law.
Program. QubikOS sends text messages on behalf of the studio where you or your child are enrolled: class schedule changes and cancellations, trial class reminders, tuition and payment reminders, and studio announcements.
You may not use the service to send unlawful, harassing, misleading or unsolicited messages, to infringe intellectual property, to attempt to gain unauthorized access to systems or data, or to interfere with the operation of the service. Studios must obtain valid consent before messaging their members and must honor opt-out requests.
Our handling of personal information is described in the Privacy Policy, which forms part of these terms. Studios retain ownership of the member data they enter and may request its export or deletion.
We work to keep the service available and secure, but it is provided “as is” without warranties of any kind, express or implied, to the maximum extent permitted by law. We do not warrant uninterrupted or error-free operation.
To the maximum extent permitted by law, QubikOS LLC is not liable for indirect, incidental, special or consequential damages, or for lost profits or data. Our total liability for any claim is limited to the fees you paid us in the twelve months preceding the claim.
We may update these terms; material changes will be reflected in the effective date above and, where appropriate, communicated to account owners. Either party may terminate a subscription in accordance with the applicable order. Provisions that by their nature survive termination will continue to apply.
These terms are governed by the laws of the State of California, United States, without regard to conflict-of-law rules.
